Just look at how vital employment agreements are in Uber’s current court battle with 19 drivers.
In a tribunal described as ‘the court case if the year in UK employment law’, lawyers representing the drivers argued that the terms and conditions of their work with Uber meant they are not technically self-employed. They should therefore be entitled to a range of benefits they do not currently have access to.
Uber is trying to avoid paying benefits claiming they are not an employee but facilitators, joining customers with drivers.
A similar case was heard in California and Massachusetts, where Uber reached a $100 million settlement to avoid the prospect of reclassifying its drivers as employees.
If Uber had drawn up a consultant or contractor agreement, Uber would have been able to mitigate risk. Travis will have kicked himself about that one.
Just look at what also happened to GrubHub, DoorDash and Homejoy.
These businesses did not have employment contracts in place, but viewed their workers as contractors. Some had worked there in excess of a year.
Unlike Uber, who could afford to shell out a large settlement fee, Homejoy had to close its doors.
If Grubhub, Doordash and Homejoy had employment contracts in place, and a staff handbook detailing procedure for employees to complain, then they would not have lost money in settlements and extensive litigation.
The misclassification of employees as independent contractors is becoming more prevalent in workplaces globally.

Just look at how much Chipotle (YUM!) had to pay out to a disgruntled employee.
In August 2016, a Chipotle employee was awarded $550,000 in compensatory and punitive damages.
The employee informed her boss that she was pregnant. Because there was no staff handbook, she was unaware of her employee entitlements. Her boss made her inform him whenever she needed the bathroom.
The last straw came when the employee told her boss she had to leave early to go to a prenatal doctor’s appointment. He ignored her, and she went anyway. The next day, he fired her in front of her fellow employees.
Although a staff handbook is not required by law, a court or tribunal will take it into account when deciding whether you’re a responsible employer when faced with an internal dispute.
