  • Advice Tailored To Your Needs

Finding the perfect team is stressful enough for any business.

Making sure that your employment practices are compliant with the law is another challenge entirely.

We understand that with all the time, money and energy you’ve invested into your business, getting your legal foundations in order is probably not the first thing on your checklist.

Don't Ignore Employment Law!

During the last five years, 6 out of 10 employers have faced an employee lawsuit with the average settlement costing around £200,000.

Ensuring your startup complies with employment regulations is becoming increasingly important to make certain your startup survives.

I mean… what startup has a spare £200,000? If you do…please let us in on your secret!

The majority of employment disputes could have been easily dismissed.

How, you ask?

IT’S SIMPLE!

If the company itself had laid out all the expectations of the employee, described the company culture, and ensured that all the right legal documents were in place to comply with the letter of law then any potential dispute could easily be resolved!

Linkilaw understands that startups can not afford settlements of this magnitude, nor afford to pay anywhere near the £3,000-£5,000 to get the correct contracts beforehand.

Startups are continually placed in a vicious cycle between lawyers’ price points and tight purse strings.

Linkilaw is here to break this cycle and make sure your relationship with all employees is watertight.

If the business had laid out its expectations, described the company culture and ensured that all its legal documents were in order any potential dispute would have been resolved.

We understand how fast paced your work is.

This is why we deliver the Employer’s Pack in 3-business days so you can work down your to-do list.

BUT WHAT DOES IT INCLUDE?

The Employer’s Pack includes essential documents when you start hiring staff. Here’s what’s included:

Employment
Agreement
£400+VAT

This is a contract between you and your employee. It details:

  • The job title, salary, time and place of work.
  • Termination and notice periods.
  • Holidays and days off.
  • Any other requirements you wish to include.

Consultancy
Agreement
£350+VAT

This is a contract between you and your consultant or contractor. It details:

  • The duties and obligations of the consultant.
  • The start date and fees.
  • Confidential information and liability.

Staff
Handbook
£400+VAT

This details out the essential policies for your employees. Apply the tone and organisational details. It includes:

  • Employee benefits.
  • Disciplinary and poor performance procedure.
  • Sickness absence policy.
  • Parental leave policies.
  • Health and Safety policy.

Don’t believe these documents
are vital to your survival?

Just look at how vital employment agreements are in Uber’s current court battle with 19 drivers.

In a tribunal described as ‘the court case if the year in UK employment law’, lawyers representing the drivers argued that the terms and conditions of their work with Uber meant they are not technically self-employed. They should therefore be entitled to a range of benefits they do not currently have access to.

Uber is trying to avoid paying benefits claiming they are not an employee but facilitators, joining customers with drivers.

A similar case was heard in California and Massachusetts, where Uber reached a $100 million settlement to avoid the prospect of reclassifying its drivers as employees.

If Uber had drawn up a consultant or contractor agreement, Uber would have been able to mitigate risk. Travis will have kicked himself about that one.

Just look at what also happened to GrubHub, DoorDash and Homejoy.

These businesses did not have employment contracts in place, but viewed their workers as contractors. Some had worked there in excess of a year.

Unlike Uber, who could afford to shell out a large settlement fee, Homejoy had to close its doors.

If Grubhub, Doordash and Homejoy had employment contracts in place, and a staff handbook detailing procedure for employees to complain, then they would not have lost money in settlements and extensive litigation.

The misclassification of employees as independent contractors is becoming more prevalent in workplaces globally.

It is understandable why startups choose this model, as it leads to a reduction in their burn rate.

HOWEVER, whether you’re hiring an employee or a contractor you need to make sure your business is covered. Each Employer’s Pack can be customised to what you need, delivered when you need it and secure your startup’s workforce from seed to success.

But… why is a Staff Handbook so important?

Just look at how much Chipotle (YUM!) had to pay out to a disgruntled employee.

In August 2016, a Chipotle employee was awarded $550,000 in compensatory and punitive damages.

The employee informed her boss that she was pregnant. Because there was no staff handbook, she was unaware of her employee entitlements. Her boss made her inform him whenever she needed the bathroom.

The last straw came when the employee told her boss she had to leave early to go to a prenatal doctor’s appointment. He ignored her, and she went anyway. The next day, he fired her in front of her fellow employees.

Although a staff handbook is not required by law, a court or tribunal will take it into account when deciding whether you’re a responsible employer when faced with an internal dispute.

WHAT COULD GO WRONG?

Why Can’t I Just Use Free Legal Documents I Come Across Online?

It’s no crime to be tempted by “free” legal documents online, which promise to safeguard your startup.

And it’s no surprise why startups fall for it.

But does it make sense to get a contract that may or may not work. The issue with these documents is that ANYONE (with or without a law degree) could have written them. If anything goes awry, or you need more clauses added to the contract, there is no one to help you!

Linkilaw is in the business of ensuring that you know what you’re paying for!

The lawyers that draft our documents have worked with Facebook, Amazon, Universal Music, Warner Bros, Dunhill and Cartier (to name a few).

Some of our lawyers are armed with over 30 years of experience in their field and will do their utmost to shield your startup from anything that will do your business harm.

A Linkilaw drafted agreement provides you with:

  • 1. Assurances that both the employer as well as the employee are clear on the terms of employment, to prevent major disputes between them.
  • 2. Even if a dispute occurs, the documents clearly outlines the terms of employment.
  • 3. In the worst case scenario, if the unsolved dispute reaches the court, then this agreement ensures a clear solution because all terms of employment are clearly documented in writing and are applicable to both parties.

These Documents Are Way Less Expensive Than What ALL Law Firms Charge. Are They Really Up To Scratch?

We mean by all means it would be easy for us to charge you lots more if you’d like us to, but we think it’s time we helped you grow and spend the appropriate amount of money.

After all our big idea is to disrupt the legal industry, and get out the way so you can grow your business.

Our lawyers used to charge extortionate fees before they left their city firms to enjoy a better lifestyle. They’re experienced in working with smaller startups through to working with some of the largest technology companies in the world. This lifestyle change allowed them to focus on lowering their costs whilst maintaining their high standards.

You need to ensure that you have the most cost-effective, experienced and relatable lawyer to support you and your needs.

How Personalised Are these Documents? How Many Changes Can I Make?

Customisation… price! Gone are the days of lawyer’s fees piling by the hour! For standard cases, our prices are fixed – from the beginning of the process until the very end.

Whatever work is needed is completed in 3 working days, as we make it our mission to understand your business in order to draft the right documents for it.

There will be exceptions if you are wanting us to write the equivalent of Tolstoy’s War and Peace, keep changing your mind backwards and forwards, or if your requests are wildly above the allotted time.

“As a founder of my own startup, it was refreshing to work with people who truly understood my business’ needs. It’s only been six months since we launched, but already I know that I’m so happy I got these documents from Linkilaw!”

OUR PRICES COMPARED WITH STANDARD LAW FIRMS

We needed to know. So we rang up lawyers and law firms in the U.K.

img-003

People didn’t like to give fixed prices. And the prices to meet with them ranged from £150 – £1,500 an hour. That’s an expensive cup of coffee if you go to their offices for a meeting.

After searching far and wide for answers, to nail down firms on their prices and to negotiate like badasses, we were able to find the average U.K. fixed price options.

Sadly, we were shocked by the result.

That was one of the reasons we swore to protect our customers from the lack of transparency and spiraling legal costs that comes from hourly rates. This is why we provide a quality service for a fixed price.
